Terms and conditions

  • The objects and all associated packaging and exhibition resources will be insured by the borrower and paid for by the borrower, from ‘nail-to-nail’ according to Dutch ‘all risk’ provisions. In other words: the objects will be all-risk insured from the moment they are removed from their position at the Jewish Cultural Quarter, up to and including the moment they are once again returned to the Jewish Cultural Quarter or to a different location as assigned by, or on behalf of, the Jewish Cultural Quarter.
  • The Borrower undertakes to take all necessary measures to protect against fire, burglary, theft, loss or damage, such as may be expected of a proper custodian and as approved by the Jewish Cultural Quarter.
  • If either of the parties or the insurer so wishes, a qualified valuer shall be hired by the borrower to compile a valuation report for the benefit of the insurance. The borrower will be informed of this in advance.
  • The borrower shall treat all information relating to the insured value with the strictest confidence and shall not share this information with third parties.
  • The borrower shall cover the costs of, and be liable for, the transportation of the objects both from and back to the Jewish Cultural Quarter, and the transportation will be carried out according to the Jewish Cultural Quarter’s instructions.
  • If it is agreed in writing that the borrower may transport the object independently by car, then this shall only happen under the supervision of at least one driver and one co-driver, whereby at least one of the two is an employee of the borrower and is authorised to sign transfer documents.
  • At no time during the transportation may the vehicle containing the objects be left unattended.
  • If a transport company is to carry out the transportation, the Jewish Cultural Quarter shall be informed of its name and address in advance. The transport company may only transport the objects if the Jewish Cultural Quarter has approved it.
  • In the interim between transportation from the Jewish Cultural Quarter and back to the Jewish Cultural Quarter, the objects may not be moved from the building they are designated for or used for other purposes than those which have been agreed with the Jewish Cultural Quarter.
  • If the Jewish Cultural Quarter deems it necessary, activities during transportation to and from the borrower will be supervised by a the Jewish Cultural Quarter courier, paid for by the borrower.
  • If the Jewish Cultural Quarter deems it necessary, condition reports will be compiled for all the objects before they are transported to the borrower. On receiving the objects, the borrower will check the condition of the objects and note any deviations in the condition report.
  • The original condition report belongs to the Jewish Cultural Quarter, the report will travel with the objects and remain with the objects until the end of the loan period. The borrower will issue a copy of the report within a week on arrival of the objects to the the Jewish Cultural Quarter.
  • If the Jewish Cultural Quarter deems it essential to hire an external expert to compile a condition report, the borrower shall cover the costs for this.
  • The borrower shall regularly check the condition of the objects. Any change in the condition of an object must be reported to the Jewish Cultural Quarter immediately.
  • Absolutely no change shall be made to the state of the objects, frames and exhibition materials without prior written permission from the Jewish Cultural Quarter.
  • If, for whatever reasons, the state of any object changes anyway, this must be reported immediately to the Jewish Cultural Quarter.
  • In the case of measures that must be taken immediately, e.g., in the case of damage, the borrower must maintain constant contact with the Jewish Cultural Quarter.
  • The borrower shall not undertake any measures whatsoever to return objects to their original state other than on instructions from and under the responsibility of the Jewish Cultural Quarter, except in cases of emergency measures about which the Jewish Cultural Quarter must be notified immediately.
  • The borrower shall enable a staff member designated by the Jewish Cultural Quarter to check the objects the Jewish Cultural Quarter has loaned out.
  • The objects may only be exhibited in buildings with stone walls and hard roofing.
  • If the Jewish Cultural Quarter requests a facility report for approval, the borrower is obligated to provide such a report.
  • No smoking, eating or drinking is permitted in the exhibition space.
  • In terms of climate and lighting, the following conditions apply:
    • the temperature must be 18°-22° C / 64.4°-71.6° F (± 2° C / 35.6° F per 24 hours), during the daytime and at night;
    • humidity must measure 50%-55% (± 5 % per 24 hours);
    • intensity of lighting for objects made of textiles and paper may not exceed 50 Lux. For other objects, it may not exceed 150 Lux;
  • In terms of security, the following conditions apply:
    • during opening hours there must be a dedicated security officer present;
    • outside of opening hours, the space housing the objects must be electronically secured.
  • Unless otherwise agreed, the name of the lender shall be mentioned in all catalogues, exhibition texts, invitations and other public information relating to every object, as follows: Collectie Joods Cultureel Kwartier, Amsterdam/ Collection Jewish Cultural Quarter, Amsterdam.
  • Photographing or reproducing the objects in any other way is not permitted unless the Jewish Cultural Quarter gives prior written permission for this.
  • 5.3 The borrower shall provide the Jewish Cultural Quarter, free of charge, two copies of any publications associated with the objects (e.g., catalogue, book, printed matter).
  • The borrower will reimburse all costs incurred by the Jewish Cultural Quarter in connection with the loan, including packaging, transportation, insurance, conservation, valuation, compilation of condition report, etc.
  • If the Jewish Cultural Quarter deems it necessary, it may request remuneration for the administration and preparation for transport of the objects.
  • The borrower will be informed in advance, in writing, of the nature and amount of the costs to be paid.
  • The borrower shall give written permission for the performance of work for which it is required to pay.
  • In the case of force majeure, including but not limited to accident, earthquake, revolt, explosion, war, hostage-taking, government intervention, inability to obtain essential authorisation / permission or any other cause of similar nature which can reasonably be deemed beyond the control of the parties, the parties’ obligations shall partially or entirely be suspended for the duration of the force majeure, without the parties being liable to each other for compensation for associated damages.
  • In the case of force majeure, the parties shall immediately initiate consultations to jointly determine how to continue or reinstate their obligations.
  • If the Jewish Cultural Quarter, in consideration of the above conditions, deems the borrower to be in breach of its obligations, the Jewish Cultural Quarter may immediately repossess all the objects – regardless of the associated consequences – without incurring any liability in terms of the consequences for the borrower.
  • The borrower may never derive from compliance with the above-mentioned provisions any rights to restitution or compensation for damages, whether already incurred or to be incurred in the future, due to whatever cause.
  • The borrower shall provide the director of the Jewish Cultural Quarter with two tickets for the opening of the exhibition. The borrower shall also send invitations to persons or institutions designated by the Jewish Cultural Quarter.
